PBHome.in Terms of Service & Conditions

1. Nature of the Platform & Intermediary Safe Harbor

PBHome.in, owned and operated by Rabaab Software Solutions ("Company", "PBHome", "We", "Us", or "Our"), functions strictly as an Intermediary as defined under Section 2(1)(w) and Section 79 of the Information Technology Act, 2000 (read with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021).

PBHome.in is an online technology discovery marketplace and community utility that facilitates the exchange of information between property owners, prospective buyers, tenants, licensed real estate agents, builders, and housing society managements.

2. Definitions of Users & Roles

For the purposes of this Agreement, the following terms shall have the meanings set forth below:

• "Visitor / Browser": Any individual accessing public, non-authenticated portions of the PBHome.in website or mobile application.
• "Property Owner": An individual or legal entity holding registered title or lawful possessory interest in real property who posts listings for sale or lease.
• "Property Dealer / Realtor / Broker": An intermediary engaged in real estate consultancy, marketing, or property broking.
• "Builder / Promoter": An entity developing real estate projects, townships, or high-rise societies.
• "Society Manager / RWA": Authorized committee members or managing personnel administering apartment societies, towers, flats, and maintenance khatas.
• "Society Resident": Lawful occupants, owners, or tenants of a registered flat or unit within a society onboarded to PBHome.in.
• "Security Guard": Personnel authorized by a Society Manager to operate gate terminal modules, verify visitor QR passes, and log entry/exit.

3. Account Registration, Credentials & Google Sign-In

To access certain features (such as posting properties, receiving verified buyer leads, operating dealer desks, or managing society gates), users must register an account.

• Single Identity & Mobile Verification: Each account is identified by a unique 10-digit Indian mobile number (+91) or a verified Google Account (OAuth 2.0). You represent and warrant that the mobile number and email provided belong to you and are active.
• Google Sign-In / OAuth: When you register or log in using "Sign in with Google", you authorize PBHome.in to receive your name, verified email, and profile avatar. You remain responsible for completing your profile with an active mobile number and accurate role designation.
• Credential Confidentiality: You are solely responsible for maintaining the confidentiality of your login credentials (passwords, PINs, OTPs, or authentication tokens). Any action executed under your account credentials shall be deemed executed by you.
• Immediate Notification: You must promptly notify PBHome.in at support@pbhome.in if you suspect any unauthorized access or security breach of your account.

4. Submission and Administration of Property Listings

PBHome.in enforces strict standards to preserve the authenticity and integrity of properties advertised on the platform. By submitting any listing, you agree to the following conditions:

4.1 Authorization & Warranty of Authority

You expressly represent and warrant that you are: (i) the absolute legal owner of the property; (ii) a registered Power of Attorney (PoA) holder authorized to sell/lease; or (iii) a licensed real estate agent possessing explicit, verifiable written authority from the legal owner to advertise the property on PBHome.in.

4.2 Listing Accuracy & Truthful Representation

All submitted listing details—including asking price, land measurement units (Marla, Kanal, Killa, Gaj, Sq.Ft.), furnishing status, number of bedrooms/bathrooms, boundary dimensions, and locality—must be genuine, accurate, and not misleading. Artificial under-pricing or clickbait valuation is strictly prohibited.

4.3 Mandatory Off-Market Withdrawal

Once a property advertised on PBHome.in is sold, leased, or otherwise withdrawn from the market, the publisher is legally obligated to mark the listing as "Sold / Closed" or delete the listing within 24 hours.

4.4 Editorial Discretion & Removal Without Notice

PBHome.in reserves the absolute, unilateral right to review, edit, reject, suspend, or permanently remove any listing from the platform without prior notice, if:

• The listing violates any provision of these Terms or applicable Indian laws.
• The property is subject to an active title dispute, police complaint, or rival broker contention.
• The listing contains duplicate submissions for the identical unit or land parcel.
• The contact numbers or pricing details are found to be fraudulent or unresponsive to buyer inquiries.

5. Intellectual Property, Photograph & Media Rights

Visual assets represent the core of property discovery. To protect users and platform integrity:

• Warranty of Media Ownership: You certify that all photographs, floor plans, walkthrough videos, and brochures uploaded to PBHome.in were created by you or that you hold full copyright authorization. Uploading watermarked media from rival portals (e.g. 99acres, MagicBricks, Housing.com) or unauthorized internet sources is strictly prohibited.
• License Granted to PBHome.in: By uploading any media, you grant PBHome.in a perpetual, irrevocable, worldwide, royalty-free, transferable license to display, host, cache, compress, watermark with the PBHome.in brand, distribute, index for search engines, and feature across promotional channels.
• Digital Watermarking: You acknowledge that PBHome.in applies proprietary digital watermarks and cryptographic hashes to listings to deter third-party content scraping.

6. Regulatory & RERA Compliance (Real Estate Act, 2016)

Under the Real Estate (Regulation and Development) Act, 2016 (RERA) and the Punjab Real Estate Regulatory Authority (PBRERA) Rules:

• Mandatory RERA Registration for Promoters: Any commercial or residential project where the land area exceeds 500 square meters or involves more than 8 apartments must be registered with the relevant State RERA authority prior to any advertisement, marketing, or booking.
• Obligations of Real Estate Agents & Dealers: Every agent, broker, or dealer advertising properties on PBHome.in must hold an active, valid RERA Registration Certificate and must prominently disclose their RERA Registration Number (e.g., PBRERA-A...) in their account profile and listing descriptions.
• Disclaimer of RERA Liability: PBHome.in acts as a neutral publisher. PBHome.in does not independently verify, certify, or warrant the compliance, status, or sanctions of any RERA registration number displayed. Buyers and investors are instructed to verify certificates directly on the official portal (rera.punjab.gov.in).

7. TRAI & DND (Do Not Call) Telecommunication Consent

In compliance with the Telecom Regulatory Authority of India (TRAI) guidelines:

This consent constitutes an express commercial communication agreement and explicitly overrides any registration on the National Do Not Call (NDNC) Registry or Telecom Commercial Communications Customer Preference Regulations (TCCCPR). You may modify your notification preferences at any time in your user settings.

8. Anti-Scraping, Data Harvesting & Lead Protection

All content on PBHome.in—including database architectures, contact directories, land measurement engines, QR code configurations, and proprietary source code—is protected under Indian Copyright and Cyber laws.

• Strict Prohibition on Data Harvesting: You shall not use any automated script, bot, spider, scraper, crawler, or software to extract, harvest, screen-scrape, or compile contact numbers, seller directories, or listing details from PBHome.in.
• Prohibition on Reselling Leads: Buyer inquiry leads generated on PBHome.in are strictly confidential and licensed solely to the specific advertiser for one-to-one property discussions. Reselling, distributing, or syndicating leads to third-party telecallers or marketing firms is strictly prohibited and constitutes an actionable offense under Section 43 and Section 66 of the Information Technology Act, 2000.

9. Society Resident Portal, Gate Security & SOS Disclaimers

PBHome.in provides smart society management software, digital QR passports for apartments and vehicles, visitor management terminals, and emergency SOS alerts.

• Digital Convenience Utility: These features operate purely as digital record-keeping and communication aids. PBHome.in is not an armed security service, private patrol agency, law enforcement replacement, or emergency responder.
• Emergency SOS Functionality: When a resident triggers the in-app SOS alarm, the platform sends network broadcasts to registered society guards and nearby residents. PBHome.in does not guarantee internet connectivity, guard response times, or physical security intervention. In life-threatening emergencies, users must immediately contact official emergency services (Police: 112 / Fire: 101 / Ambulance: 108).
• Visitor Data Privacy: Society Managers and Guards represent that visitor photos and mobile numbers logged at security gates are collected solely for society safety and comply with applicable data protection principles.

10. Payment Terms, Commercial Listings & Subscriptions

Where paid services are subscribed to (e.g. Featured Property Boosts, Dealer Desk Subscriptions, Banner Ads, or Society SaaS modules):

• 100% Advance Payment: All service subscriptions, featured listing upgrades, and SaaS access fees must be paid 100% in advance through our authorized payment gateways or designated UPI channels.
• Non-Refundable Policy: Payments made towards any service, package, or credit quota are strictly non-refundable and stand fully appropriated immediately upon activation of the service or publishing of the listing. No partial refunds or pro-rata adjustments shall be granted for early termination, listing removal, or account deactivation.
• Taxes & Invoicing: All fees are exclusive of Goods and Services Tax (GST) unless explicitly stated otherwise. Applicable GST will be levied at the prevailing statutory rates.

11. Disclaimers of Warranties & Limitation of Liability

THE SERVICES, CONTENT, AND LISTINGS ON PBHOME.IN ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

PBHOME.IN EXPRESSLY DISCLAIMS ALL WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FREEDOM FROM COMPUTER VIRUSES, AND NON-INFRINGEMENT. PBHOME.IN DOES NOT WARRANT THAT PROPERTY INFORMATION IS ERROR-FREE, UP-TO-DATE, OR FREE FROM ENCUMBRANCES OR DISPUTES.

12. Indemnification

You agree to defend, indemnify, and hold harmless PBHome.in, Rabaab Software Solutions, its affiliates, directors, officers, employees, and licensors from and against any and all claims, liabilities, damages, judgments, penalties, losses, costs, and expenses (including reasonable attorney fees) arising from or relating to:

1. Your breach of any provision of these Terms & Conditions.
2. Any property listing, image, text, price representation, or media uploaded by you.
3. Any dispute between you and another user (including title disputes, brokerage fees, or non-payment of rent/purchase money).
4. Your violation of the Real Estate (Regulation and Development) Act 2016, Punjab RERA Rules, or municipal bylaws.

13. Grievance Redressal Mechanism & IT Rules 2021

In accordance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, PBHome.in has designated a Grievance Officer to address user concerns, complaints regarding content, or violations of intermediary guidelines.

Any notice of intellectual property infringement or takedown request must specify the exact URL, title of listing, and demonstrable proof of ownership.

14. Governing Law & Jurisdiction

This Agreement shall be governed by, construed, and enforced in accordance with the laws of the Republic of India, without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to this Agreement, your use of PBHome.in, or transactions facilitated through the platform shall be subject to the exclusive jurisdiction of the competent courts located in Punjab, India (specifically Courts having jurisdiction over SAS Nagar Mohali / Ludhiana / Sangrur).
